OUR CONTRACT – the boring STUFF (but we’ve tried to make it readable)

Welcome to our website, maintained and run by me, The Whisky Don. You can contact me with any questions, at any time, via our Contact Us form. I’d love to hear from you!

You must be of legal drinking age wherever you are to view the website, and you must be over 18 to order any products from us – which at the moment I’m afraid we can only deliver to addresses in the UK. If you’re buying a gift for someone else, they must be over 18 too and you must please answer truthfully when you’re asked to confirm that they are. It’s illegal for us to sell alcohol to anyone under that age.

Here’s what else you need to know:

Ordering is easy, whisky lovers

Once an order for a Drambox or a subscription is placed and payment in full is received, or for pay-monthly subscriptions once the first instalment is received (thank you!) your order will be accepted and you will receive an email confirming your order. Please ensure you enter your email address and the all-important delivery address including postcode correctly when filling in your details. Thank you.

You can cancel a subscription at any time – see below. But once a one-off order has been accepted by us, you cannot cancel it. However, if you accidentally place a duplicate order, please contact us and if the order has not been processed or dispatched then we may be able to cancel the duplicate order and give you a refund (less any transaction charges from the payment and card companies). We won’t charge you an admin fee.

As our drams are specially selected and some are from small distilleries, they just might become unexpectedly unavailable. If that happens after you’ve placed an order, we reserve the right to replace any individual dram within a Drambox with a suitable alternative.

We don’t expect this to happen, but should a specific Drambox you have ordered be out of stock, we will contact you to offer you a suitable alternative. If you would prefer not to receive the alternative Drambox, your order will be cancelled and the price you paid for the Drambox ordered will be refunded in full to you.

Many subscribers like to receive a surprise each month. But if you’re a need-to-know person, you are welcome to ask us for a list in advance of the Dramboxes you will receive and we will give you as complete a list as we can but, particularly with 12-month subscriptions, some of the Dramboxes may change during the course of your subscription (and see above about how some drams may have to be replaced). The Dramboxes on our website are representative of the variety and style of boxes you will receive. If you have a particular dram or Drambox from our selection that you definitely want to receive, let us know and we will do our best to make it happen.

And it’s just as easy to become a club member

Once you’ve bought an annual membership to and payment in full is received you will become a fully-fledged member of the Whisky Don Whisky Club! You will receive an email confirming your membership and setting out all you need to know about how to enjoy it to the full. If the email is hiding in your spam folder, please save me as a contact to ensure you don’t miss any important updates.

You cannot cancel your membership, but if you accidentally place a duplicate order, please contact us and we may be able to cancel the second order and give you a refund (less any transaction charges from the payment and card companies). We won’t charge you an admin fee.

You will receive a second email within 48 hours containing your personalised discount code which is valid for 12 months. (Please check your spam folder if it doesn’t arrive.) Your code will entitle you to £10 off one ticket for each monthly tasting event held in your area and should be input when you get a prompt as you buy your event tickets online.

We don’t renew your membership automatically, as no one likes money being taken from their card unexpectedly! But we’re sure you’ll love the Whisky Don journey so much you’ll be keen to keep travelling the whisky world with us. So we will be in touch when your renewal rolls round.

Payment

We only accept payment by the methods displayed on our website at the time the order is placed.

If you have an offer or discount code, this needs to be applied during the checkout process. We are not able to apply offers or codes retrospectively. Please note that only one offer or discount code may be used per order. We reserve the right to reject an offer or discount code if we suspect it has not been validly obtained or is not being properly used.

All payments are processed by our third party payment processer, currently Stripe (though this may change in future. Stripe is responsible for keeping your payment details secure and for correctly processing your payment, but we have selected them because of their strong security protections. Please click here to see how Stripe process your payment data and more information about their security. The Stripe Privacy Policies can be seen here. Authority for payment for club memberships, Dramboxes ordered individually, one-off subscription payments and for the first monthly payment of pay-monthly subscriptions will be requested from your card issuer at the time you submit your order. If the payment is declined, we will not be able to accept your order. If this happens, we will try to notify you via the contact details you have provided and will hope we can re-organise payment with you.

From the second Drambox onwards with pay-monthly subscriptions, the second and further payments will be taken on or shortly before the 10th of the calendar month following the date of the first payment and provided each subsequent payment is successfully received subsequent Dramboxes will be posted to you no later than the 15th of the month.

If you have purchased a pay-monthly subscription and any payment for the second or subsequent Drambox is not made or is declined, we will try to contact you to seek an alternative payment method, but if that is not possible and/or the amount remains outstanding for more than 7 days, your subscription will sadly be cancelled. See below for further details on cancellations.

Membership and subscription renewals are not done automatically and we require your express consent for them. We will email you between 2 and 4 weeks before your membership expires or before your final Drambox is sent to you to offer you the opportunity to renew with us, and will send you reminders, but do feel free to contact us at any time if you are keen to secure your renewal or to extend your subscription.

If the price of any membership or subscription changes during your subscription period, you will NOT be charged an increased amount.

Delivery should be smooth and hassle-free

Once a Drambox order is accepted, your Drambox will be dispatched within 2 working days, but hopefully much quicker. Should you require a different posting date, please contact us and we will do all we can to accommodate such requests

All Dramboxes will be sent via Royal Mail to the delivery address given. It is your responsibility to give us the correct delivery address and postcode please. Our Dramboxes are designed to fit through your letterbox so there should not be any problems with missed deliveries because you are not in, but just in case there are any, it is your responsibility please to take the necessary steps to rearrange the delivery.

You should allow up to 6 working days for delivery of all new orders. If your Drambox is needed more urgently, please contact us and we will try to help. For our subscribers, you should look out for your second and subsequent Dramboxes from 4 working days after the 15th of each subsequent month.

We cannot unfortunately take responsibility for any delays by the Royal Mail.

We are unable to refund orders that cannot be delivered due to any address issues but should we become aware of such problems we will make every effort to contact you and sort things out, though if additional delivery costs are incurred we reserve the right to charge you for these.

If you do not receive your full, correct order by the expected date (which should not happen as we take great care processing our orders) please contact us promptly and in any event within 7 days of the expected delivery date to let us know. You can choose to have any missing items either refunded or redispatched to you (free of charge), and you can keep and pay for any incorrectly sent items or return them in their original packaging and in good condition please to us by Royal Mail second class post at our expense. Any liability to you will be limited to the price of any undelivered goods. If replacement items are sent and the original item turns up, please let us know and you may either pay for and keep it or send it back to us in its original packaging and in good condition please by Royal Mail second class post at our expense. Proof of the contents and state of packaging at the time of delivery of incomplete deliveries may be required.

If your order arrives damaged (which should not happen as our packaging has been specially selected and tested to withstand the rigours of the postal and delivery system) you must contact us promptly and in any event with 7 days of the delivery date to let us know. We will arrange with you for the price of any unusable damaged goods to be refunded in full to you. Any liability to you will be limited to the price of any unusably damaged goods. Proof of damage may be required.

Cancelling a Drambox subscription

If you wish to cancel your Drambox subscription part way through you may do so at any time by emailing us and paying the current pay-monthly cost for each of the items already dispatched to you. The pay-monthly costs will be based on the current lowest pay-monthly cost for the number of Dramboxes already dispatched. We will be sorry to see you go and you would be welcome back at any time!

We reserve the right to refund or cancel any order at any time for any reason. I can’t imagine we’ll ever want to cancel an order unless a payment is declined. But if it is necessary to do so you will become liable to us for the current pay-monthly cost for each of the items already dispatched to you. The pay-monthly costs will be based on the current lowest pay-monthly cost for the number of Dramboxes already dispatched. You will indemnify us for all reasonable costs, expenses and outgoings incurred by us in securing any payment owed.

Bits and pieces

We hate spam. So we won’t be selling or sharing your data with anyone unrelated third parties. We will have to share it with our payment processors and maybe some others – check out our privacy policy or cookie policy to find out more.

Please don’t resell anything you buy from us.

All content on the website, including all the intellectual property in it as a whole and in each individual element of the site and in our branding is owned by The Whisky Don and may not be copied or used without my prior written consent.

The Whisky Don is not responsible for any losses which are not a foreseeable or likely consequence of your use of the site or purchase of the products available, and in any event our liability is limited to the total value of the products or subscriptions purchased via the site in the order giving rise to any potential claim. But nothing in these terms affects our liability for any matters liability for which can’t be excluded or limited in law.

We will not be deemed to be in breach of contract or of these terms as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

Your contract with us is governed by the laws of England and Wales, and any disputes arising under it must be resolved in the English or Welsh courts.

If any of these terms are held by an English or Welsh court to be unlawful, invalid or unenforceable in whole or in part, that term or part of it will be invalid, but the remaining terms will remain in force.

These terms may be changed at any time without express notice to you if you are a returning user. But don’t worry, anything that affects orders, memberships or subscriptions won’t change for anything already purchased.

Or how we collect, use and share your personal information when you visit our website or make a purchase from it.

What information do you collect?

When you visit our website, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse our website we collect information about the individual web pages or products that you view, what websites or search terms referred you to the website, and information about how you interact with the Site. We refer to this information, which is collected automatically by Cookies, Web beacons, tags, pixels and log files, as Device Information.

When you make a purchase or attempt to make a purchase on our website, we collect certain information from you, (which we call Order Information) including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.

Our website is not intended for individuals under the age of 18. We do not intentionally collect personal information from children. If you are the parent or guardian and believe your child has provided us with personal information, please contact us to request deletion.

How do you use that information?

Our legitimate interests purpose in processing your data is the fulfilment of our contract with you and you and the growth of our business.

We use the Order Information to fulfil any orders you place through our website, to communicate with you; to screen our orders for potential risk or fraud; and (if it’s in line with the preferences you have shared with us), to join you to our newsletter, to contact you for market research purposes and to provide you with information or advertising relating to our products or services or, only if you’ve expressly agreed to it, relating to third party products and services we consider may be relevant or of interest to you.

We use the Device Information to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our website (for example, by generating analytics about how our customers browse and interact with our site, and to assess the success of our marketing and advertising campaigns).

When you place an order through our website, we will maintain your order Information for as long as is necessary for our legitimate business purposes unless you ask us to delete this information. We keep Device Information only for as long as is necessary.

Do you share my information?

We hate spam as much as you.  We don’t sell or lease your information to third parties, save that:

  • only because it’s necessary we share your Order Information with Stripe (our payment provider who processes payments for us).  You can see how they use your information here.
  • we share your information with Google Analytics who will give us insights into how our customers use our website (and you can read their privacy policy here and opt out of Google Analytics here
  • we may also have to share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
  • if you have consented to it, we may use your personal information to join you to our newsletter and to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For more information about how targeted advertising works, you can visit the Network Advertising Initiative’s (“NAI”) educational page. You can opt out of targeted advertising here  for FACEBOOK, GOOGLE and BING.

What else should I know?

We do not alter our site’s data collection and use practices when we see a Do Not Track signal from your browser.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us.

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

DRAMBOX and SUBSCRIPTION FAQs

What whisky will I get?

We often use single malt scotch whiskies, but we wouldn’t be true explorers if we didn’t bring you whiskies from around the world too, and if we didn’t sometimes offer you the best of other grain whiskies as well. But the quality will always be high and the drams delicious.  We only consider drams from the best and most exciting distillers for inclusion in our Dramboxes. Have a look at the Dramboxes on our website to get a flavour of the drams on offer.  And rest assured we won’t send you the same dram twice!

When will you send me my whisky?

I know, you can’t wait to get your hands on our amazing Dramboxes.  We can’t wait for you to receive them either! We’ll dispatch your order as soon as we can and it’ll come by Royal Mail.  Delivery usually takes 2-6 working days depending on where you live.  If you have a subscription, subsequent Dramboxes will be sent out by the 15th of each month starting the next month.  So if you start a subscription in the first half of a month, you may have to wait a bit longer than a month for your second box to arrive – contact us if you want your first two boxes closer together and we’ll do our best to speed things along for you).

Can I order a Drambox or subscription as a gift for someone else?

Yes.  What a lovely friend you are.  Just let us know on the ordering page that this is a gift, make sure you give us the lucky recipient’s name and delivery address including postcode and let us know what message you’d like us to send.  We’ll send you an email confirmation in the usual way.  We’ll also send an email gift confirmation either to you for you to forward to your friend, or if you prefer and you give us their email address, we can email it directly to them letting them know the exciting news.

Can I pick a delivery date eg for a birthday?

Yes, if you tell us the delivery date you want when you order the Drambox then so long as it’s at least 6 working days away we will hold it and only post it 6 days before your chosen delivery date.  If you need it quicker than 6 days, contact us and we’ll see what we can do!

What if my Drambox doesn’t arrive?

If you think your Drambox is late or if it doesn’t arrive, please contact us and we’ll sort it out for you.

What if my Drambox is damaged?

Our packaging has been specially selected to survive the rigours of the delivery process, and we’ve successfully stress tested it too.  But in the unlikely event it somehow gets damaged, please contact us with all your details.  If you can send us a picture, that will help.

What if I move house during my subscription?

No problem, just contact us and let us know your new address.

Can I cancel my subscription?

Yes, if you want to, you can cancel at any time by getting in touch with us and letting us know. See our terms for the (minimal) charges for doing so.  We’ll be sorry to see you go and you’ll be welcome back at any time

Will my subscription automatically renew?

No, but we will contact you in good time before your subscription expires in order to invite you to renew so you don’t run dry

I don’t live in the UK.  Can you still send me a Drambox?

We’d love to, but right now we can’t: we can only delivery to UK addresses. Sign up for our newsletter, or keep an eye on our social media or our website to be the first to hear if that changes.

WHISKY DON WHISKY CLUB MEMBERSHIP FAQs

What discounts does my membership entitle me to?

All members receive £10 off the price of one ticket to every tasting in their area for a year.

How do I get my discount?

Once you become a fully fledged club member, you will receive an email with your unique membership discount code.  You just need to input the code when prompted to do so when buying your ticket(s) online.  The code is valid for a year and entitles you to one discounted ticket per event in your area. Please check your inbox for an email setting all you need to know about how to enjoy your membership to the full.  If it’s hiding in your spam folder, please save me as a contact to ensure you don’t miss any important updates.

How often are the tastings?

Monthly.  There will be 11 a year.  That’s one a month, except in August when there are so many holidays. So if you come to them all, that makes an annual saving of £60! What’s not to love about that!

What if I can’t come to one of the tastings?

We’ll miss you, but no problem. You obviously won’t want to buy a ticket. BUT, if you still fancy tasting all that delicious whisky, let me know and I will make up a pack of driver’s drams to post to you.

What whiskies will we be tasting?

Every tasting night will either be hosted by a VIP guest from a wonderful distillery, or by me.

The distillery nights will feature whatever drams the distillers want to showcase to all you whisky lovers.  My nights will always have a theme, and many of them will also be available as Dramboxes.  Currently on the menu we have a “Spiritual Homeland Tour” taking your around Scotland’s five official whisky regions with a wonderful single malt specially selected from each one to showcase the region’s typical style; “Dram Queens”, a tasting which proudly celebrates five women who are well and truly calling the shots in the whisky world; and “Around the World in 5 Drams” which takes us on an international adventure of five of the finest whisky-producing nations. No passport required!  And coming up: Peaty Blinders, Celebrity Whiskies and many, many more.
